With reference to paragraph 2 (h) of my despatch Ro.405 of the 11th of August, I have the honour to inform you that after prolonged and careful consideration I have

reached the conclusion that Cleus 14 of the draft

Ordinance to consolidate and arend the low with reord

to Deleterious Drugs, (like Section 12 of Ordinance No.124 which it is designed to replace) is likely to be inequitable in its operation.

2. I observe from the Attorney General's memorandum

on the 3111 that the amendments incorporated in this

Clause were designed to ready to some extent the legiti-

mate rievances of the Kasters of Shing who on occasion

had been convicted and fined under Section 12 of Ordinan os

No.124 and the corresponding, section in Ordinanco F6,117

(Chandu Revenue) although it was admitted that they had

no kowledṣs that opium or rugs were being imported on

opiumaru

their shine and it was not supeated that they had

omitted to eroine reasonable supervision.

I am hove vor advised that the extension of

liability to the Chief Engineer and Chin Chew (to which

attention is drawn in the Attorney General's enoranciam)

is not permissible, as they should not be made criminally
